The European Spallation Source ERIC Legal Function manages and develops the provision of legal services to enable ESS to meet its objectives and act within the law. The Legal Function supports the construction, operation and decommissioning phases of the Organisation.

The availability of legal advice will enable ESS to meet its objectives and to minimise unnecessary liabilities and risk while ensuring the Organisation’s compliance with applicable law.

The Legal Function accomplishes these purposes primarily by providing legal and risk management advice and assistance to management and staff on a full range of issues that may impact ESS. All legal services to ESS are attainable through the Legal Function.

To provide:

  • legal advice and support on a wide range of legal matters
  • clarification on legal issues, options or potential outcomes
  • support through external legal specialists where needed

To ensure:

  • the legality of the organisation
  • all contracts with ESS are legally sound and contain acceptable risks to the organisation
  • the organisation’s compliance with applicable laws and regulations
  • management is properly alerted to legal risks to the organisation

Statutes of the European Spallation Source ERIC

The European Commission implementing decision (EU) 2015/1478 of 19 August 2015 on setting up the European Spallation Source as a European Research Infrastructure Consortium (European Spallation Source ERIC) can be viewed on their website.

ESS Code of Conduct

The Code of Conduct is a set of rules outlining the responsibilities and proper practices for individuals employed by ESS. The rules are developed by and for ESS and express its business principles, values and norms, and the appropriate behaviour for ESS Staff.

ESS Intellectual Property Rights and Inventions Policy

The European Spallation Source ERIC has adopted the Intellectual Property Rights and Inventions Policy to govern the dissemination, exchange, ownership, use and protection of technical knowledge, intellectual property rights and know-how created in or arising from the ESS project.


Procurement Rules

The European Spallation Source ERIC procurement rules apply to all contracts for the provision of goods, works and services, concluded in writing between ESS and third parties and financed by the ESS budget.
